Last updated: November 6, 2025

These Terms & Conditions (“Terms”) govern your use of Otherwhere (the “Services”). By using the Services, you agree to these Terms.

1) What We Do

Otherwhere is an information and referral service. We surface travel options and link you to partners who supply flights, hotels, and other travel products. We do not own, operate, or control the travel services you book.

2) Your Responsibilities

• Provide accurate information when using the Services.

• Review all details, fare rules, terms, and policies on the partner’s website before booking.

• Comply with all applicable laws and third-party terms.

3) Affiliate Relationships

We may receive a commission if you purchase through our links. This does not affect the price you pay. Recommendations are based on your inputs and available data, but you should always review full results and partner terms before booking.

4) Prices, Availability, and Content

Prices and availability come from third parties and can change at any time. We do not guarantee accuracy or availability and are not responsible for errors, outages, or changes made by partners.

5) No Booking or Payment on Otherwhere

All bookings and payments occur on partner websites. Any issues with reservations, payments, changes, cancellations, or refunds must be handled with the partner according to their terms and policies.

6) Acceptable Use

Do not:

• misuse the Services, attempt unauthorized access, or disrupt operation;

• scrape, copy, or redistribute content except as allowed by law;

• use the Services for unlawful purposes.

We may suspend or terminate access for violations.

7) Intellectual Property

The Services, including text, design, and software, are owned by us or our licensors and protected by law. You agree not to reverse engineer or create derivative works except as permitted by law.

8) Disclaimers

The Services are provided “as is” and “as available.” We disclaim all warranties to the maximum extent permitted by law, including fitness for a particular purpose and non-infringement. We do not warrant uninterrupted or error-free operation.

9) Limitation of Liability

To the maximum extent permitted by law, Otherwhere and its affiliates are not liable for indirect, incidental, special, consequential, or punitive damages, or lost profits, arising from your use of the Services or third-party offerings. Our total liability for any claim will not exceed USD $100.

10) Indemnity

You agree to indemnify and hold harmless Otherwhere from claims arising out of your use of the Services or violation of these Terms.

11) Changes to the Services and Terms

We may modify or discontinue features at any time. We may update these Terms by posting a revised version with a new “Last updated” date. Continued use constitutes acceptance.

12) Governing Law & Dispute Resolution

These Terms are governed by the laws of [Province/State, Country], without regard to conflict-of-laws principles. Courts in [City, Province/State] shall have exclusive jurisdiction. If you prefer arbitration, replace this clause with your standard arbitration provision.

Affiliate disclosure

Otherwhere participates in affiliate programs with travel partners. If you click a link and make a purchase, we may earn a commission. This helps keep our service running while keeping the experience free for you. We do not sell flights or accommodation ourselves; all bookings are completed on the partner’s website with their terms and policies.
